There are two different things called parental leave in Australia and confusing them causes real problems.

The government payment, administered by Services Australia. This is a payment, funded by the Australian Government, available to eligible parents.

Employer parental leave, which comes from your employer under an award, an enterprise agreement or a workplace policy. Some employers pay generously, some pay nothing beyond the legal minimum entitlements, and what applies to you is in your own employment documents.

They are separate and they can often be taken together or in sequence, depending on your employer’s arrangements. Neither one replaces the other automatically.

This article states no rate, duration, threshold or dollar figure, because they are adjusted and any number printed here would be wrong. Services Australia is the authority on the government payment and the Fair Work Ombudsman on employment entitlements.

The government payment

What it is: a payment to eligible parents caring for a newborn or newly adopted child.

Who assesses it: Services Australia, against criteria including a work test, an income test, residency requirements and the care of the child.

How it is paid: arrangements vary, and it can be paid through an employer or directly by Services Australia depending on circumstances.

It is taxable income, which matters for your household’s tax position and for any other payment that depends on income.

The rules have changed in recent years, including how the payment is shared between parents and how flexibly it can be taken. This is a genuine reason to check the current position rather than relying on what a friend received two years ago.

Employer parental leave

Separate, and it is where the variation is.

Unpaid parental leave is a legal entitlement for eligible employees under the Fair Work Act, and the Fair Work Ombudsman publishes what that involves, including notice requirements and the right to request an extension.

Paid employer leave is not universal. Some employers offer it, some do not, and the amount, duration and eligibility differ enormously.

Check three documents: your award or enterprise agreement, your employment contract, and your employer’s parental leave policy.

Ask your employer directly what you are entitled to and how it interacts with the government payment. This is a normal question and HR answers it constantly.

Superannuation is worth asking about specifically, since arrangements for super on parental leave vary and have been the subject of policy change.

The four things to do before the birth

1. Claim early. Services Australia allows claims to be lodged before the birth in most circumstances, and claiming early avoids a gap in income at the point you least want one. Check the current timing rules, because there are limits on how early and how late a claim can be made.

2. Sort your myGov and Centrelink link now. Setting up access, linking services and verifying identity takes longer than expected and is considerably harder to do with a newborn.

3. Get your employer’s position in writing. What they pay, for how long, whether it can run alongside or after the government payment, what happens to super, and what notice they need.

4. Work out the household cash flow across the whole period, not just the paid part. Most households have a period with reduced income and increased costs, and knowing where the low point falls is the difference between planning and scrambling. Things that catch people out

Assuming the two systems are one. The most common confusion, and it produces both under-claiming and unpleasant surprises.

The work test. Eligibility depends on work history before the birth, and the details matter for anyone with casual, seasonal, contract or interrupted work. Check with Services Australia rather than assuming you are ineligible, because people commonly assume wrongly in both directions.

Income estimates. Where a payment is income tested, an estimate that turns out to be wrong is reconciled later, which can create a debt. The same mechanism causes trouble with Child Care Subsidy, as described in Child Care Subsidy explained.

Not telling Services Australia about changes. Income, work, relationship status, care arrangements. Updating promptly is the single most effective way to avoid a debt.

For the other parent

Arrangements exist for partners, and these have changed in recent years including how the payment can be shared.

It is worth both parents checking their own position rather than assuming it applies only to the birth parent, because take-up among partners is affected by people not realising they are eligible.
